PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING ANY OF OUR SERVICES.

THESE TERMS AND CONDITIONS (“TERMS”) REPRESENT A LEGAL CONTRACT BETWEEN “YOU” AND SC EDM BUSINESS PROJECT CONSULTING SRL, having unique identification number 42357441, with headquarters in Str. Grigore Ionescu, No. 63, Block, T73, Scara 2, Floor 4, Ap. 42, Sector 2, Bucharest, postal code 23674, Romania and/or any of its subsidiaries and affiliates (collectively “EDM AJUTORFINANCIAR”, “NOI “, “OUR”).

THESE TERMS EXPLAIN HOW YOU ARE ALLOWED TO USE THE WEB PAGES LOCATED AT THE URLS AJUTORFINANCIAR.RO, AS WELL AS ALL ASSOCIATED WEBSITES AFFILIATED BY EDM AJUTORFINACIAR, SUBSIDIARIES AND AFFILIATED COMPANIES (COLLECTIVELY, THE “SITE”). UNLESS OTHERWISE SPECIFIED, ALL REFERENCES TO “THE SITE” ALSO INCLUDE THE SERVICES, MATERIALS, CONTENT, SERVICES AVAILABLE THROUGH THIS SITE AND ANY COMPUTER PROGRAM THAT EDM AJUTORFINANCIAR PROVIDES FOR YOU TO DOWNLOAD. (ALL OF THESE COLLECTIVELY CALLED THE “SERVICE”).

Using our services, by accessing, downloading or using any of our Apps, products, Site, or Service in any way; by accessing the Service through Third Party Platforms, including social networks; by pressing the “ACCEPT” button, or by completing the registration process, YOU. YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THESE TERMS AND CONSENT TO THE COLLECTION, USE AND STORAGE OF YOUR INFORMATION. AS SPECIFIED IN EDM FINANCIAL AID’S PRIVACY AND COOKIE POLICY. (All of the above, collectively “YOUR ACCEPTANCE”).

IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, OR IF AT ANY TIME THE TERMS ARE NO LONGER ACCEPTABLE TO YOU, PLEASE DISCONTINUE USING THE SERVICE IMMEDIATELY.

THESE TERMS REQUIRE INDIVIDUAL BINDING ARBITRATION TO RESOLVE DISPUTES. IF YOU ARE A ROMANIA RESIDENT, PLEASE NOTE THAT, UNDER CERTAIN CIRCUMSTANCES, YOU MAY BRING A DISPUTE BEFORE THE RELEVANT AUTHORITIES OR COURTS IN ROMANIA.

  1. GENERAL USE AND MODIFICATIONS

The Service is licensed to you, not sold.

EDM AjutorFinanciar reserves the right to deny any user access to the Service at any time without notice, for any reason, including but not limited to violation of the Terms. You agree that EDM AjutorFinanciar may suspend or discontinue the Service (or any functionality) or change the content of the Service at any time for any reason, with or without notice, and without liability.

IF YOU ARE NOT AT LEAST 13 YEARS OF AGE, YOU MAY NOT USE ALL SECTIONS OF THE SERVICE OR SUBMIT ANY INFORMATION TO EDM FINANCIAL AID OR THE SERVICE. IF YOU ARE AT LEAST EIGHTEEN (18) YEARS OF AGE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THESE TERMS. IF YOU ARE A PARENT OR LEGAL GUARDIAN OF A MINOR USING THE SERVICE, YOU HEREBY AGREE THAT YOU HAVE REVIEWED AND CONSENT TO THESE TERMS TO BIND THE MINOR TO THESE TERMS AND TO FULLY INDEMNIFY AND RELEASE EDM FROM ANY LIABILITY IF THE MINOR BREACHES ANY OF THESE TERMS. IF YOU ARE A MINOR, YOU ARE AWARE THAT YOU NEED YOUR GUARDIAN’S PERMISSION. LEGAL TO USE THE SERVICE.

If you are a parent or legal guardian of a minor, you hereby agree to subject the minor to these Terms and to fully indemnify and hold harmless EDM AjutorFinanciar from any liability if the minor violates any of these Terms. EDM AjutorFinanciar may change, update or add or remove any of these Terms at any time by posting the updated Terms of Service and notifying you either through a banner within the Service or, depending on your account status, by email at sole discretion EDM Financial Aid. These Terms will enter into force within 3 days of publication.

By using the Service after EDM AjutorFinanciar has updated the Terms, you agree that all updated Terms; if you do not agree to any of the updated Terms, you must stop using the Service. Also note that these Terms may be superseded by specially designed legal notices or terms located in certain features of the Service. These notices or specially designed legal terms are incorporated into these Terms and supersede the provisions of those Terms that are designated as superseded.

You understand and agree that the Service (and any Applications) evolves. Thus, EDM AjutorFinanciar may require you to download and install new versions of the Service at any time without notice or liability to you. You also understand and agree that any such changes or updates to the Applications may change the specifications of system necessary to use the Application and, in such cases, you and not EDM AjutorFinanciar are responsible for purchasing any software and/or hardware necessary to access and use the Application. You acknowledge that when a new version is available, previous versions of the Mobile Application may no longer be available or maintained by EDM AjutorFinanciar.

  1. CONFIDENȚIALITATE

Any information provided by you and used by our Service is subject to our Privacy and Cookie Policy.

  1. USE OF THE SERVICE

(a) Visitors and Guests. If you are a visitor, you will be able to view and use certain features of the Service that are available without registration. You do not need to register with EDM AjutorFinanciar just to visit and view the Site, public information about the Service or to download certain available materials or the Mobile Applications.

(b) Account Registration. To access certain features of the Service you may be required to become a Registered User. For the purposes of these Terms, a “Registered User” is a user of the Service (“User” or “user”) who has a registered account with us (“Account”).

(c) Registration Data. By registering for the Service you agree (i) to provide true, accurate, current and complete information about yourself as requested in the registration form (“Registration Data”); and (ii) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. You are responsible for all activities that occur under your Account. You may not disclose your Account and password to anyone, and you agree (A) to notify EDM AjutorFinanciar immediately of any unauthorized use of your password or any breach of security ; and (B) log out of your Account at the end of each session. If you provide any information that is not true, accurate, current or complete, or EDM AjutorFinanciar has reasonable grounds to suspect that such information is not true, accurate, current or complete, EDM AjutorFinanciar has the right to suspend or terminate your Account. and to refuse any current or future use of the Service (or any part thereof). EDM AjutorFinanciar reserves the right to remove or recover any username at any time for any reason, including but not limited to claims by a third party that a username infringes the third party’s rights.

(d) Network Access. When you access the Service over a mobile network, rates and charges for data, messages, etc. will apply. of your network or roaming provider. The download, installation or use of certain Services may be prohibited or restricted by your network provider, and not all functionality of the Service may work with your network provider or your device.

  1. RULES OF CONDUCT

By using the EDM AjutorFinanciar Service you agree NOT (or ask another user to do so):

  • Sign up if you are under 13 years old;
  • act or not permit conduct that violates the rules of the Third Party Platforms, provided that access to such platforms is made through the Service;
  • register using a false identity or information or on behalf of someone other than yourself;
  • register and not use the Service if you have previously been prohibited from using the EDM AjutorFinanciar Services;
  • register your Site or Service to promote, solicit or transmit any commercial advertisements, including chain letters, junk email or repetitive messages (spim and spam) to any person;
  • use your Account or the Service to engage in illegal conduct;
  • use another user’s data without permission;
  • use the Site or Service in a manner that violates any applicable law or regulation or that is prohibited by these Terms;
  • collect or not retrieve any information about other users;
  • post, solicit or link to sexually explicit, threatening, embarrassing, hateful, racially, ethnically or religiously offensive, inflammatory, misleading, hurtful, defamatory, libelous or otherwise inappropriate or offensive material;
  • discuss, promote or depict any form of sexuality, abuse, child exploitation or similar topics that may harm or concern the safety of a child or minor;
  • use the functionality of the Site or the Service for purposes other than those intended;
  • interfere with or disable any security functionality of the Site or Service, or any part thereof, including any Service available on or through any Third Party Platform;
  • decipher, decompile, disassemble, rewrite the source programs or otherwise attempt to extract any code or ideas or algorithms of any part of the Service, including any Service available through the Third Party Platforms;

Any use of the Service in violation of these limitations is strictly prohibited, may result in the immediate revocation of your license, and may subject you to liability for violation of law. EDM AjutorFinanciar reserves the right to determine what conduct is considered to violate the rules of use or not to fall within the purpose or spirit of these Terms of Use or the Service. In the event of a violation of any of the above provisions, EDM AjutorFinanciar will decide in its sole discretion what action, if any, it will take, including closing your Account, banning you from using the Service and/or informing the relevant authorities.

  1. PAYMENT OF FEES

EDM AjutorFinanciar does not charge any kind of fee for using the services on this website.

  1. TERM AND TERMINATION

(a)

Term. The Terms begin on the date You accept them (as described in the preamble above) and remain in effect as long as You use the Service, unless it is terminated earlier in accordance with the Terms.

(b) Termination. If you wish to terminate the Service, you may do so (a) by notifying EDM AjutorFinanciar at dpo@ajutorfinaciar.ro any time; (b) We reserve the right to terminate or suspend your access to any or all of the Services at any time and for any reason. It is at our discretion to delete your registration for reasons that we believe violate these Terms. If we close or suspend your Account, you will no longer have access to it or other functionality associated with it.

Effect of Termination. Termination of any functionality of the Service includes removal of access to that functionality. Termination of the Service includes the deletion of all information, related files and Consent associated with your Account (or any part thereof), including your Content. EDM AjutorFinanciar shall have no liability to you for any suspension or termination, including the deletion of Content All provisions of the Terms which by their nature must survive shall survive termination of the Service, including but not limited to provisions regarding ownership, disclaimer of warranty and limitation of liability.

  1. DISPUTES BETWEEN USERS

You are solely responsible for your own interactions with other users of the Service. EDM AjutorFinanciar may, at any time, intervene in disputes between you and other users, but has no obligation to do so. EDM AjutorFinanciar will not be responsible for what results from these disputes, including but not limited to claims and damages of any kind. If you have a dispute with one or more users, YOU RELEASE EDM AJUTORFINANCIAR (and its officers, directors, agents, subsidiaries, affiliates and employees) FROM ALL CLAIMS, DEMANDS AND DAMAGES (direct and related) of any kind and nature, known and arising out of or in connection with such disputes.

  1. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” AND WE DO NOT REPRESENT, PROMISE OR WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE OR THAT DEFECTS WILL BE CORRECTED. You agree that your access to and use of the Service is at your own risk. TO THE FULLEST EXTENT PERMITTED BY LAW, EDM AJUTORFINANCIAR, ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE. THEREOF, INCLUDING THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AUTHORITY, COMPLETENESS, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. EDM AjutorFinanciar makes no warranty or representation regarding the accuracy or completeness of the content of the Service or the content of any site linked to the Service and, to the extent permitted by applicable law, assumes no liability or responsibility for any of the following:

  • errors, mistakes or inaccuracies in the content;
  • personal injury or property damage of any nature resulting from your access to and use of the Service or the Site;
  • any unauthorized access or use of our secure servers and/or any and all information and/or financial information stored therein;
  • any interruption or cessation of transmission to or from the Service;
  • any bugs, viruses, Trojan horses or the like that may be transmitted to or through the Service or Site by any third party;
  • any errors or omissions in the content or for any loss or damage of any kind suffered as a result of the use of any content posted, emailed, transmitted or otherwise made available through the Service and/or Site.
  1. LIMITATION OF LIABILITY

EDM AJUTORFINANCIAR WILL NOT BE LIABLE TO YOU IN ANY WAY. OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING ANY LOST PROFITS OR LOST DATA, RESULTING FROM YOUR USE. OF THE SERVICE OR OTHER MATERIALS ACCESSED THROUGH OR DOWNLOADED FROM OUR SERVICE, BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, OR WHETHER OR NOT EDM AJUTORFINANCIAR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The above limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. You expressly acknowledge that EDM AjutorFinanciar will not be liable for the defamatory, offensive or illegal conduct of any third party and that the risk of injury or damage from the foregoing rests entirely with you.

THE ABOVE DISCLAIMER AND LIMITATIONS OF LIABILITY DO NOT AFFECT YOUR RIGHTS AS A CONSUMER OR INTEND TO LIMIT LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE ROMANIAN LAW.

  1. COMPENSATION

You agree to indemnify and hold harmless EDM AjutorFinanciar, its shareholders, subsidiaries, affiliates, officers, employees, agents, partners and licensors (collectively the “EDM AjutorFinanciar Parties”) against any and all losses, costs, liabilities and expenses (including the reasonable fees of lawyers) relating to or arising out of: (a) Your Content; (b) your use of, or inability to use, the Service; (c) your breach of the Service; (d) your violation of any rights of other parties, including any User; or (e) your violation of any applicable laws, rules or regulations. EDM AjutorFinanciar reserves the right, at its own expense, to assume the exclusive defense and control of any matters otherwise subject to indemnification by you, in which event you will fully cooperate with EDM AjutorFinanciar in support of any defenses available. You agree that the provisions of this section will survive any termination of your Account, the Terms, or your access to the Service.

  1. INTELLECTUAL PROPERTY OWNERSHIP AND LICENSE

You acknowledge that all intellectual property rights in our Service and related technology and all information and content available on or through the Service (excluding User Content) are owned by us and/or our suppliers.

The Service is protected by copyright laws worldwide. Subject to your compliance with these Terms and any other relevant EDM AjutorFinanciar policies, EDM AjutorFinanciar grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license for your personal, non-commercial use only. No other use of the Service is authorized. Subject to this authorization, you agree that any copy of the Service’s functionality or its components that you make will retain all copyright and other proprietary notices in the same form and manner as the original.

You may not use, download, upload, print, display, perform, reproduce, publish, license, post, transmit, modify, create derivative works of, uninstall, disassemble, decompile, adapt, distribute, transfer or otherwise exploit the Service or its functionalities or components, in whole or in part, without our prior written authorization.,

We and our suppliers reserve all rights not granted in these Terms. There are no implicit licenses.

All trademarks, logos and service marks displayed on the Service (“Marks”) are our property or the property of third parties. You are not permitted to use these Marks without the prior written consent or consent of such third parties who may own the Marks.

  1. APPLICABLE LAW AND ARBITRATION AGREEMENT

These Terms and any action related to these Terms shall be governed by and construed in accordance with the laws of Romania. Note that, in certain circumstances, you may invoke the protection that is granted to you by the laws of Romania

You can report any complaints to the National Authority for Consumer Protection, http://www.anpc.gov.ro/

  1. GENERAL

These Terms, together with the Privacy Policy, constitute the entire agreement between you and EDM AjutorFinanciar regarding your use of the Service (Site, Service and all related content) and supersede and supersede any prior written or oral agreements regarding the foregoing. Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of that right or provision. If any provision of these Terms becomes illegal, void or unenforceable for any reason, then that provision will be severed from the Terms and will not affect the validity and enforceability of the other provisions. Neither the rights nor the obligations under these Terms are assignable to you, and any such potential assignment or transfer will be null and void. We may assign these Terms without restriction. You may not use, export, import or transfer the Service except as authorized by the laws of Romania. You will not use the Service for any purpose prohibited by Romanian law, including the development, design, manufacture or production of missiles, nuclear, chemical or biological weapons. You confirm and agree that the products, services or technology provided by EDM AjutorFinanciar are subject to the laws and regulations of control in Romania and the European Union.
